These Terms of Service (“Terms”) govern your use of sudsncharge.com, our installable web app and related services (the “Services”) operated by Suds n Charge, based in Carlsbad, California (“Suds n Charge,” “we,” “us”). By using the Services you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. What Suds n Charge is
Suds n Charge is an online directory and marketplace that helps people find independent mobile auto detailers and places where a car can be detailed while it is parked or charging. Suds n Charge does not perform detailing services and does not employ the detailers listed on the Services. Detailers are independent businesses that set their own prices, methods and schedules and are solely responsible for their work.
2. Eligibility and accounts
You must be at least 18 years old to create an account or book a service. You agree to give accurate information, keep your sign-in details secure, and are responsible for activity on your account. We may suspend or close accounts that break these Terms or put others at risk.
3. Listings
- Some listings are created from publicly available business information and are marked as not yet claimed. Business owners can claim, update or remove them at any time; see Business Listings.
- Listing information comes from detailers, locations and public sources. We try to keep it accurate but do not guarantee that any listing, price, availability or description is complete or current.
- Suds n Charge may verify a detailer’s city business license and liability insurance. Verification is limited to those documents and is not an endorsement or guarantee of any detailer’s work. You are responsible for checking out and choosing a detailer.
4. Bookings and payments
Payments are not currently processed through the Services; during this period you arrange and pay for service directly with the detailer. When in-app booking and payment become available, the price, any service fees, and cancellation and refund terms will be shown before you confirm, and our Refund & Cancellation Policy will apply. Payments will be processed by our payment processor, Stripe, under its terms.
5. Charging and partner locations
Charging stations, parking areas and other partner locations are usually private property. Detailers may work only at locations that have agreed to participate, must follow each location’s rules, and must use a dirty-water catch mat or equivalent containment. Customers and detailers must sign the applicable waiver before using partner locations. Suds n Charge does not operate charging equipment and is not responsible for charger availability, pricing or performance.
6. Reviews and content you post
Reviews must be honest and based on your own experience. You may not post content that is false, misleading, defamatory, hateful, harassing, infringing or unlawful, or that includes someone else’s private information. You keep ownership of your content but give Suds n Charge a non-exclusive, royalty-free, worldwide license to host, display and use it to operate and promote the Services. We may remove content at our discretion.
7. Acceptable use
Do not misuse the Services, including by scraping, interfering with security, impersonating others, creating fake listings or reviews, arranging work off-platform to avoid fees once payments are enabled, or using the Services for any unlawful purpose.
8. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, SUDS N CHARGE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THE QUALITY, SAFETY OR LEGALITY OF ANY DETAILER’S SERVICES OR ANY LOCATION.
9. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SUDS N CHARGE AND ITS OWNERS, EMPLOYEES AND PARTNER LOCATIONS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR DAMAGE TO ANY VEHICLE OR PROPERTY CAUSED BY A DETAILER, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF $100 OR THE FEES YOU PAID TO SUDS N CHARGE IN THE 12 MONTHS BEFORE THE CLAIM. Some jurisdictions do not allow these limits, so they may not fully apply to you.
10. Indemnity
You agree to defend and hold harmless Suds n Charge and its partner locations from claims arising from your use of the Services, your content, your violation of these Terms, or, for detailers, the services you provide.
11. Disputes with detailers
Any agreement for detailing services is between the customer and the detailer. Please report problems through our Report a Problem page; we may help resolve disputes and may remove detailers or customers who repeatedly break these Terms, but we are not obligated to do so.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in San Diego County, California, and you consent to their jurisdiction.
13. Changes and termination
We may update these Terms by posting a new version with a new effective date. Continued use after changes means you accept them. You may stop using the Services at any time, and we may suspend or end access for any violation.
